Acceptance of Terms

By downloading, accessing, or using the Thankful mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. Thankful reserves the right to modify these Terms at any time, and your continued use of the App following any changes constitutes acceptance of the updated Terms.

Description of Service

Thankful is a mobile application designed to help couples build stronger relationships through:

• Daily gratitude exchanges between partners
• Mood tracking and emotional awareness
• Relationship quizzes and discovery activities
• Notes history and journaling
• Featured articles on relationships and gratitude

Account Registration

To use the App, you must:

• Be at least 13 years of age
• Provide accurate and complete information during registration
• Maintain and update your account information
• Accept responsibility for all activities that occur under your account
• Keep your account credentials secure and confidential

You may use Apple Sign-in to create your account. You are responsible for maintaining the security of your Apple account.

Partner Connections

The App allows you to connect with one partner to share gratitude notes, mood entries, and other data. By connecting with a partner, you agree to share the data specified in the connection request. You acknowledge that both you and your partner can view and interact with shared content. Thankful is not responsible for any disputes that may arise between connected partners.

User Responsibilities

As a user of the App, you agree to:

• Use the App only for its intended purposes
• Not engage in any conduct that could damage, disable, or impair the App
• Not attempt to gain unauthorized access to the App or its systems
• Not use the App to transmit any harmful, illegal, or inappropriate content
• Respect the privacy and rights of other users, especially your connected partner
• Not use the App for harassment, abuse, or any form of harmful behavior

Content Guidelines

You retain ownership of the content you create in the App, including gratitude notes, mood entries, and other user-generated content. By submitting content to the App, you grant Thankful a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of providing the App's services.

You agree not to submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. Thankful reserves the right to remove any content that violates these guidelines.

Premium Subscriptions

Thankful may offer premium subscription features ("Premium Features") for a fee. Premium subscriptions are subject to the following terms:

• Subscription fees are charged through your Apple App Store account
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• You can manage your subscription through your Apple App Store settings
• Refunds are handled according to Apple's refund policy
• Thankful may modify or discontinue Premium Features at any time with reasonable notice

Privacy and Data

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

Intellectual Property

The App, including all content, features, and functionality, is owned by Thankful and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without express written permission from Thankful.

Disclaimers and Warranties

The App is provided on an "as is" and "as available" basis. Thankful makes no warranties, express or implied, including but not limited to:

• uninterrupted or error-free operation of the App
• Accuracy, reliability, or completeness of the App's content
• Results obtained from using the App
• The App will meet your specific requirements or expectations

Thankful does not guarantee that the App will be secure, free from bugs, or that any defects will be corrected.

Limitation of Liability

To the fullest extent permitted by law, Thankful shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the App. Thankful's total liability to you for all claims shall not exceed the amount you paid, if any, for using the App during the preceding twelve months.

Termination

Thankful reserves the right to terminate or suspend your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Thankful may also delete your account and all associated data in accordance with our Privacy Policy.

You may terminate your account at any time by deleting the App and contacting us at hello@thankfuldaily.com to request account deletion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Thankful is established, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Indemnification

You agree to indemnify, defend, and hold harmless Thankful, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
